Subpoena

After an action has been initiated, a party may issue either a Subpoena ad Testificandum requiring a person or organization to testify in court, or issue a Subpoena Duces Tecum requiring them to produce evidence or records before the court.

Deposition Subpoena requires a person, who is not a party to the lawsuit to appear at a deposition as part of the “discovery process” before trial.

Subpoenas are served pursuant to the statutes of the CPLR (Civil Practice Law and Rules) and FRCP (Federal Rules of Civil Procedure). They have their own service time restrictions. UPSI is privy to all the service requirements for the various subpoenas, so you can be assured of timely service.
